Our condominiums are built on a plot of land under building rights. Building law is a real right and is also referred to in Austria as “building on someone else’s property”. This means that when you buy an apartment on lease, you acquire the right to live in, rent out or otherwise use a specific apartment within a building while the property continues to be owned by another party. In this case, the building right is granted for a fixed period of 100 years. At the end of this term, the property, including the structures on it, reverts to the property of the landowner.
Since the property remains in the property of the building owner, the purchase price for the apartment is often lower than for comparable apartments under “normal” ownership.
Due to the lower purchase price, an investor can also expect a significantly higher return. Newly built apartments in central locations can usually be rented very well on the open market.
As a rule, the term of the building lease contract is long-term, in our case even 100 years. During this time, the apartment owner can use, rent, bequeath or sell the apartment and thus has a certain degree of flexibility.
Since the building contract regulates the rights and obligations of both parties, it usually offers a certain level of investment security for the apartment owner.
In Austria, since 2016, the acquisition costs and additional costs when buying a property can only be depreciated at 60 percent based on the building. Since the land is not purchased when you purchase a condominium, the investment costs can be written off at 100 percent. Due to this cost advantage for a retirement apartment under construction law, the investment becomes very lucrative.
